Bennett, Coleman & Co. Limited (hereinafter referred to as ‘BCCL/we’) is a company incorporated within the provisions of the Companies Act, 2013, having its registered office at The Times of India Building, Dr. D.N. Road, Mumbai 400 001 and its corporate office at Elbee House, 2 nd Floor & 3 rd Floor, Boat Club Road, Siddharth Path, Pune 411001.

By agreeing to Times Impact Advertising Package (hereinafter referred to as ‘Package’) and by participating in the ‘TIMES IMPACT Contest’ (hereinafter referred to as the ‘Contest), you agree to the following terms and conditions and accept them unequivocally and agree to abide by them:

  1. The contest shall be known as 'The TIMES IMPACT Contest' and shall commence on 20 th May 2019 and closes on July 31, 2020 or on a date at the sole discretion of BCCL.
  2. The Contest is organized managed an d conducted by BCCL.
  3. The selection of winner shall take place in the month of June 2020 or any other suitable date, at a place to be announced later by BCCL.
  4. Mere participation or buying of Times Impact package does not guarantee publishing of any Advertisements in BCCL publications or any prize.
  5. Notwithstanding anything contained herein, in the event of any breach of terms of this Contest or non-fulfilment of the Package, you shall be liable to pay for the advertisements at the Maximizer rates prevailing at the time of consumption of the advertisements.
  6. ELIGIBILITY CRITERIA :
    1. The employees of BCCL, its subsidiaries and affiliates (collectively known as The Times Group) and the employees’ immediate family members (including spouses, children, parents, brothers and sisters), are NOT eligible to participate.
    2. Entry is open to any corporate entity, person or the authorised representative of any person or corporate entity, purchasing and fully completing a Package. Any Participant who does not consume or fulfil the Package shall not be eligible for the Contest or Winner selection.
    3. Strictly only one Participant is allowed to use one Package. Package(s) cannot be shared amongst different companies, subsidiaries or affiliates.
    4. The Package cannot be clubbed with any other offer of BCCL. Packages cannot be clubbed and released together as a single ad.
    5. Existing customers (customers advertised in any of BCCL’s publications prior to 1 st January 2018) may take up Package(s) based on one of the following criteria – new customer to that environment or small or inconsistent advertiser or who did not advertise during past 6 months. The Package(s) are not available in conjunction with any other offers or discounts of BCCL.
  7. TIMES IMPACT PACKAGE DETAILS AND OTHER CONTEST TERMS:
    1. Each of the Times Impact Package shall include one free advertisement production, plus 3 copy changes across 12 months. Any images or logos are to be supplied in appropriate format by the Participant or the authorised representative of the Participant at its cost. BCCL reserves the right to publish only appropriate advertisement as per our standard norms.
    2. Participant may elect to pay the total charges in advance and/ or in the alternative the Participant can pay as per the Payment Plan, annexed to the Booking form.
    3. In the Booking form, the Participant should specifically mention against whom should BCCL raise an invoice; in the name of the Advertising Agency or in the name of the Participant. BCCL shall raise an invoice based on the aforesaid instruction. It will be the sole responsibility of the Participant on whom bills are raised to honour all the commitments as per the terms and conditions set out in the package.
    4. In case the Participant cancels the Package, in whole or in part, BCCL shall forfeit any and all payments made to BCCL by the Participant towards purchase of the Package and consequently, shall be disqualified from the Contest and Winner selection process.
    5. Participant/s who does not complete their Package for the full term is/are not eligible and will get disqualified to participate in the Contest and/or Winner selection.
    6. To be eligible and be included in the Contest and/or Winner selection, all payments for all the Packages must have been paid in accordance with payment/credit terms on or before 30 th May 2020. All payments must be made by a Participant in full and final to the satisfaction of BCCL.
    7. Each Participant or their authorized nominee will receive token(s) for each Package. One entry for each ‘mini’ Package, two entries for each ‘junior’ Package, three entries for each ‘standard’ Package, four entries for each ‘super’ Package and five entries for each ‘mega’ Package.
  8. CONTEST WINNER PROCEDURES AND RULES:
    1. The Participant or duly authorised representative must be present at the winner selection venue to claim their prize.
    2. The winner should have paid in full for all The Times Impact packages packages prior to taking delivery of the prize.
    3. The winner will be selected on the basis of their answers to general knowledge questions and a winner selection process via independent draw. The prize of the Contest is one (1) brand new car (hereinafter called the “Vehicle”). The Vehicle shall include the default standard fittings from relevant manufacturer.
    4. The Vehicle does not include any registration, on road costs, tax, insurance and delivery – these are the responsibility of the winner.
    5. The Winner shall be liable for all taxes and levies including GST, in relation to the prize / Vehicle. The Winner shall deposit the applicable tax on the price of Vehicle and provide to BCCL the original challan duly stamped by the bank evidencing the deposit of TDS or any other applicable tax in favour of "entity business name" for claiming the prize within 7 days from the date of declaration of winner. Thereafter BCCL shall not entertain any claim for the prize.
    6. The Vehicle will be delivered immediately once account has been settled in full, and subject to stock availability & compliance of these terms & conditions and further the winner acknowledges a firm order being placed with the dealer constitutes the winning of the Vehicle. BCCL shall not be responsible for any damage or alterations to the Vehicle.
    7. BCCL shall not be responsible for any defects/inadequacy/deficiency in the prize and the same shall have to be addressed to the manufacturer or distributor or supplier directly.
    8. The Vehicle is not redeemable for cash or kind and must be taken as offered. The prize shall be non-transferable.
    9. If the winner is under eighteen (18) years of age then the Vehicle will be awarded to the winner’s parent or guardian subject to the compliance of the applicable terms & conditions to them.
    10. The shortlisted winner(s) may be featured in BCCL newspaper subject to editorial discretion, BCCL policies and applicable laws and at the sole discretion of BCCL.
    11. Winners shall not conceal or misrepresent any information during the scrutiny or otherwise, failing which the Participant shall be disqualified for participating in the Contest.
  9. BCCL reserves the right, at its absolute discretion, to substitute any of the prize or Vehicle with any other prize or Vehicle of similar value at any time, without prior notice.
  10. All decisions concerning any aspects or dispute connected in any way with the trade promotion will be made by BCCL, whose decision will be final. No correspondence or appeal will be entertained.
  11. BCCL, its sponsors or associated companies shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to incidental, indirect, consequential, special or punitive loss, damage or expenses and these include but not limited to business interruptions, lost business, lost profits or lost savings) or for personal injury which is suffered or sustained in connection with the prize or Vehicle.
  12. BCCL reserves the right to use the names and/or photographs of the Participants as materials for the purposes of advertising and publicity and the Participants shall not be entitled to claim ownership or other forms of compensation on the materials. Participants may also be required to give comments for press releases, photographs, video, media interviews, and at any announcement event (s).
  13. All rights, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and / or images, posts, texts, videos or any such material submitted by the contestants/Participants shall vest solely and exclusively with BCCL at all times.
  14. The release of advertisement in furtherance of the Package shall always be subject to applicable laws, BCCL Policies and its editorial discretion in relation to the content of the advertisement. Any rejection or modification or alteration in release of any advertisement due to applicable laws and/or BCCL policies and/or editorial discretion shall not be considered as breach of the Terms and Conditions.
  15. BCCL is not responsible for compensating any Participant/s for any fines/ legal action imposed by the regulatory authorities on the advertiser as a consequence of running their advertisement.
  16. In the event of non-availability in a certain week or section, any advertisement under any Package will be re-scheduled on the next available day. Space subject to availability.
  17. All advertisements must appear latest by July 31st, 2020. Any unscheduled ads at that date will be forfeited by the BCCL.
  18. Advertisement copy is required at least 3 working days prior to publication. For lift out sections or preprints, material should be submitted at least 7 working days prior to publication.
  19. All entries will be treated as the property of BCCL and can be used by BCCL for any promotional and / or commercial activity & the participants/winners waive all rights of whatsoever nature in the said entries in favour of BCCL by participating in the contest.
  20. The Contest shall be governed by and construed in accordance with the laws of India and the courts of Mumbai shall have exclusive jurisdiction to try any claim or issue or dispute.
  21. The Participants shall ensure that the advertisement material submitted for publication shall not violate any law for time being in force, or of any third party rights including intellectual property rights.
  22. The Participant agree to indemnify BCCL and keep BCCL, its directors, employees or associates harmless against any and all direct or indirect losses, actions, claims or damages of any nature incurred or suffered by us as a result of publication of the advertisements in BCCL publications, or in the event of breach of the given terms and conditions. This clause shall survive the term of this agreement.
  23. In the event of any term, condition or provision of this Terms & Conditions being held to be in violation of any applicable law, statute or regulation, the same shall be deemed to be severable from the other provisions of this letter and this letter shall be construed as if such term, condition or provision had not been contained in this letter.
  24. BCCL in its absolute discretion reserves the right to add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part, at any time without giving any prior notice and the participant/winner agrees to abide by such additions, alterations, modifications and changes.
  25. Nothing contained herein amounts to a commitment or representation by BCCL to conduct further or other contests.
  26. BCCL editorial policy may change across the course of this program. Advertisements will be scheduled with the most appropriate editorial, should any change occur to publishing day or content.
  27. All disputes shall be subject to the exclusive jurisdiction of Mumbai Courts only.
  28. BCCL reserves the right to withdraw and/or alter any of the terms & conditions of this Contest at any time, without prior notice.
